July 1, 2026, Chisinau – Whistleblowers will have increased guarantees of confidentiality, clear rules for reporting violations and protection against retaliation.The provisions are included in the bill draft developed by the Ministry of Justice and approved today by the Government.
"For citizens, this project means safety when they choose to report a violation. For institutions and the business environment, it brings clearer rules, accountability and more efficient internal mechanisms. For the state, it strengthens integrity, transparency and public trust," said the Minister of Justice, Vladislav Cojuhari.
The draft clarifies the scope of the law and establishes the categories of violations that can be reported.Reports will be able to cover both national legislation and European Union acts, including violations related to the EU's financial interests and the functioning of the internal market.
The new provisions expand the obligation to establish internal reporting channels.These will be mandatory for all public entities, for private entities with at least 50 employees, as well as for some smaller private entities operating in high-risk areas (e.g. financial services, money laundering prevention, transport, environmental protection).For private entities with between 50 and 249 employees, the use or sharing of internal reporting channels will be allowed, while respecting confidentiality.
The draft also strengthens the guarantees regarding the protection of the whistleblower's identity.The identity of the reporting person, as well as any information that could lead to their identification, may only be disclosed in the cases and under the conditions provided for by law.The same rule will also apply when the warning is received through other channels or by persons other than those officially designated.
At the same time, the circle of protected subjects is expanded.In addition to whistleblowers, protection will be provided to persons who assist them, those in professional or personal contact with them, including family members, as well as legal entities associated with whistleblowers.
The draft strengthens the role of the Ombudsman in monitoring the application and effectiveness of protection measures.To exercise the new duties, the staffing limit of the Ombudsman's Office will be increased by three units.
The National Anticorruption Center will have the power to publish annual statistical data on external reporting.Whistleblowers and other protected subjects will also have access to information, counseling and, where appropriate, state-guaranteed legal assistance.
The legislative initiative responds to the commitments undertaken by the Republic of Moldova in the process of alignment with European standards in the field of the rule of law and whistleblower protection.
