September 16, 2026, Chișinău – The Government approved an amendment to the Regulation on the procedure for filing and examining patent applications and granting patents. The draft decision was prepared by the Ministry of Justice and the State Agency on Intellectual Property (AGEPI).
The amendments regulate the procedures necessary for the operation of the European patent system in the Republic of Moldova. Through AGEPI, applicants will be able to file a single European patent application, with the possibility of obtaining protection in the 40 member states of the European Patent Organisation. At the same time, European patents will also take effect within the territory of the Republic of Moldova.
At the same time, the national system for the protection of inventions is aligned with European Union regulations regarding supplementary protection certificates for medicinal and plant protection products, and a number of procedures applied by AGEPI have been simplified and clarified. One example is the timeframe for examining oppositions, which will be reduced from six to three months.
"For patent applicants and holders, the changes mean clearer and more predictable procedures, access to the European patent system, and rules aligned with those applied in the EU," stated Minister Vladislav Cojuhari during the government meeting.
The draft was developed in the context of the commitments undertaken by the Republic of Moldova during the European Union accession process—specifically under Chapter 7, "Intellectual Property Law," of the National Accession Program for 2025–2029—and following the amendment of the Law on the Protection of Inventions.
